New Delhi: The FIR filed by the Delhi Police concerning the assault on AAP Rajya Sabha MP Swati Maliwal reveals disturbing details of the incident that took place at the residence of Delhi Chief Minister Arvind Kejriwal on May 13.
According to the FIR, Maliwal was severely assaulted by Kejriwal’s close aide, Bibhav Kumar, prompting her to approach the police.
On May 13, around 9 am, Maliwal visited CM Arvind Kejriwal’s residence at 6, Flagstaff Road, Civil Lines, Delhi, to meet him.
In her complaint, Maliwal stated that she entered the residence area and informed the staff to convey her message to CM Kejriwal. She was informed that Kejriwal was present and was directed to wait in the drawing room.
“I went inside the camp office and called CM’s PS Bibhav Kumar but received no response. I then sent a WhatsApp message. Still, there was no reply. I entered the residential area as I had done in the past year and informed the staff to tell the CM I was here to meet him,” the FIR states.
“Suddenly, Bibhav Kumar barged into the room, screaming and verbally abusing me without provocation. I told him to stop and call the CM,” Maliwal recounted in the FIR.
Kumar responded harshly, saying, “How dare you not obey us? Your status is so low that you won’t refuse us. You’re a lowly woman; we’ll teach you a lesson,” according to Maliwal.
She described how Kumar then stood right in front of her and, without any provocation, began hitting her repeatedly.
“He slapped me at least 7-8 times while I screamed for help. I was shocked and tried to protect myself by pushing him away with my legs. He then pounced on me, dragged me, and deliberately pulled my shirt up, causing the buttons to come undone,” the FIR details.
Despite her pleas for him to stop, Kumar continued to assault her, kicking her in the chest, stomach, and pelvic area. Maliwal explained that she told Kumar she was in severe pain due to her menstrual period, but he continued to attack her. She eventually managed to break free, gathered her glasses, and called the police.
When Kumar realized she had called the police, he left the room and returned with security personnel, who asked her to leave. Maliwal sat outside in pain until the police arrived. Dazed and traumatized, she eventually walked to her previous residence in Civil Lines.
“I reached my earlier residence and sat on the ground. Some police personnel called me an auto on my request. I was in terrible pain and traumatised but managed to go to the police station to report the matter,” Maliwal said.
At the Civil Lines police station, she informed the SHO about the incident but left without filing a written complaint due to extreme trauma and pain.
“The past few days have been extremely painful and traumatic. I am in constant pain and have difficulty walking. I feel shattered that someone I knew could behave so violently,” she said.
Maliwal has since submitted a written complaint and requested the strongest possible action. The FIR was filed under IPC Sections 308 (attempt to commit culpable homicide), 341 (wrongful restraint), 354B (assault or criminal force with intent to disrobe), 506 (criminal intimidation), and 509 (insulting the modesty of a woman).
Maliwal also recorded her statement before a magistrate at Delhi’s Tis Hazari court under Section 164 of the Code of Criminal Procedure.
