New Delhi: A court here on Friday sought Tihar jail’s response on Chief Minister Arvind Kejriwal’s application seeking to allow his wife to join a medical board constituted to determine his health condition and treatment.
Additional Sessions Judge Mukesh Kumar directed the authorities concerned to file their reply in the matter by Saturday.
Kejriwal is lodged in Tihar jail after being arrested in a money laundering case linked to the alleged Delhi excise policy scam.
Meanwhile, the judge has also fixed a Saturday hearing for an application by Kejriwal. This application seeks permission for his wife to participate via video conference in the medical board proceedings, which will assess Kejriwal’s health condition and treatment.
“The accused has filed an application seeking directions to allow his wife to join the medical board. Before making any decision, I find it appropriate to request a response from the concerned jail superintendent.
The application will be considered tomorrow,” stated the judge.
During the court session, the ED urged to adjourn the matter until June 25. However, the judge emphasized that he would prioritize the convenience of the accused over the probe agency’s request.
“The accused is currently in judicial custody, not in your custody. If he requires any accommodation, you have no jurisdiction in that matter. He is under judicial custody. I will consider his convenience, not yours,” remarked the judge.
Earlier on June 5, the court had rejected Kejriwal’s plea for interim bail on medical grounds. Nevertheless, it instructed Tihar jail authorities to ensure Kejriwal’s medical needs are met while he remains in custody.
The judge extended Kejriwal’s judicial custody until June 19 during the previous hearing.
